Scope and Contract Partner

1) These general terms and conditions apply to all business relations between Helvetic Language Institute GmbH (“helveticinstitute.com”) and its customers.

(2) The general terms and conditions apply in the respective version at the time of the conclusion of the contract. Depending on the customer’s terminal, this document can be printed and / or saved (“Save file as”).

Registration

(1) Each order requires prior registration as a customer. A multiple registration under different names or addresses is not permitted. The customer is admitted to the system by successfully completing the registration procedure.

(2) The authorisation may be revoked at any time. In this case, Helvetic Language Institute GmbH is entitled to immediately block and delete the user name and password.


Conditions of the Contract

(1) The representation of the collection does not constitute an offer to conclude a purchase contract with the customer. It is non-binding.

(2) By placing a purchase order via the Internet, the customer makes a binding offer to conclude a purchase contract. The customer receives a confirmation of the receipt of the order by e-mail (order receipt confirmation). This confirmation of receipt does not constitute acceptance of the offer, but is intended only to inform the customer that the order has been received by Helvetic Language Institute GmbH .

3) A purchase contract for physical products is made when Helvetic Language Insitute GmbH accepts the offer of the customer by sending the ordered product to the customer or sending it to the customer with a second e-mail (confirmation of shipment) Is confirmed.

(4) If Helvetic Language Institute GmbH can not accept the offer of the customer, the customer will be informed about the non-availability or rejection of the order instead of the acceptance of the order. Temporary titles which are not available are recorded for the customer, the customer’s order remains. The customer may be advised separately about possible errors in the information on the product range on the website and, if possible, a corresponding counter offer.

(5) Helvetic Language Institute GmbH remains entitled to partial deliveries and partial settlements at any time. If partial deliveries are carried out, Helvetic Language Institute GmbH accepts the additional shipping costs. In the event of delays in delivery, the customer will be informed promptly.


Price and Payment

(1) Price fluctuations are possible. The price stated at the time of the offer is decisive.

(2) Helvetic Language Institute GmbH accepts only the methods of payment indicated to the customer in the course of the ordering process.

(3) Subject to the provision in paragraph 4, the purchase price as well as any shipping costs which may be incurred shall be due upon conclusion of the contract.

(4) Vouchers are only redeemed at the terms indicated on the voucher and exclusively for the merchandise groups notified on the voucher. It is not statutory to sell vouchers or coupon codes without the prior written consent, in order to trade in any way, or to purchase vouchers or voucher codes purchased from third parties or purchased vouchers or voucher codes.

(5) In the case of payment by means of a voucher, any residual credit shall be credited to the customer account and automatically calculated on the next order.


Cancellation

1) Helvetic Language Institute grants the customer a voluntary right of cancellation. The customer is entitled to cancel their declaration of consent to the conclusion of the contract without giving reasons within 14 days after receipt of the goods in written form (eg letter, e-mail,) or by returning the goods. The period begins on the date of receipt of the goods by the recipient. The timely dispatch of the cancellation or the goods is sufficient to meet the cancellation period. The cancellation in written form is to be addressed to the address given in point 1 or by e-mail to customerservice@shop.helveticinsitute.ch. The customer bears the burden of proof for the return of the goods.

(2) In the case of an effective cancellation, both parties must reimburse the services already received. If the customer is only able to return the received goods in a deteriorated condition, they have to make a declaratory sentence.

(3) The customer has to bear the costs and risk of the return, unless the delivered goods does not correspond to the ordered.

(4) Until the complete return of the goods, Helvetic Language Institute  makes use of its right of retention.

(5) In the event of the exclusion of the cancellation and the return, the customer shall bear the costs of resending the goods to them.


Warranty

(1) If the delivered goods are defective at the time of the transfer of risk, eg due to a manufacturer’s fault, or if a wrong delivery or an incomplete remaining delivery occurs, Helvetic Language Institute shall, at its option, either replace or cancel the purchase and return the purchase price to the customer.

(2) Helvetic Language Institute reimburses the postage of the return in the case of incorrect delivery or delivery of defective goods.

(3) The warranty claim of the customer expires if s/he does not determine the defect or the wrong delivery within 14 days after receipt of the goods or within 14 days after delivery by e-mail (customer.service@helveticinstitute.ch), telephone or post .


Liability

1) All cases of breaches of contract and their legal consequences as well as all claims of the customer, irrespective of the legal reason for which they are made, are regulated in these terms and conditions. In no event shall the customer’s claims for compensation for damages not resulting from the product itself. This also applies to the personal liability for damages of our employees, employees, employees, representatives and vicarious agents. A liability claim which exceeds the value of the order is excluded.

(2) The exclusion of liability according to the above paragraph 1 does not apply to unlawful intent (intent) or to gross negligence.

(3) The products ordered may only be used for the agreed and intended use. For other applications, prior written consent must be sought.

Helvetic Language Institute GmbH undertakes to treat the personal data of the customer according to the data protection regulations. For details, please refer to the separate data protection.
